This Privacy Policy explains how Nexcom AI LLC ("Nexcom AI," "we," "us," or "our") collects, uses, discloses, and protects information in connection with our websites, products, demos, software, and services, including GrowthStarter AI, GrowthMap Interview, and Lead Concierge AI (collectively, the "Services").
By using the Services, visiting our website, requesting a demo, or communicating with us, you acknowledge this Privacy Policy. If you use the Services on behalf of a business, you represent that you are authorized to provide information to us on that business's behalf.
1. Information We Collect
We may collect the following categories of information:
- Contact information: name, email address, phone number, company name, job title, and business address.
- Account information: login details, account settings, client workspace information, role, permissions, and preferences.
- Business profile information: services offered, service areas, average ticket size, business goals, target customers, offers, and onboarding answers submitted through GrowthMap Interview.
- Lead and customer data: names, contact details, lead source, service needs, notes, pipeline stage, appointment details, estimates, campaign status, and communication history that our customers upload or enter into the Services.
- Voice, chat, and WhatsApp content: messages, transcripts, call metadata, scheduling requests, and related conversation details processed by Lead Concierge AI.
- Calendar and scheduling data: appointment times, availability, customer booking details, confirmation emails, and company notifications.
- Payment and billing data: billing contact details, subscription status, transaction records, invoices, and payment processor identifiers. We do not store full credit card numbers.
- Device and usage data: IP address, browser type, pages viewed, feature usage, timestamps, diagnostic data, cookies, and similar technologies.
- Support and communications: emails, form submissions, support tickets, feedback, and demo requests.
2. How We Use Information
We may use information to:
- Provide, operate, maintain, and improve the Services.
- Create client workspaces, import leads, manage pipelines, and generate reports.
- Power AI-assisted features such as lead analysis, message drafts, interview summaries, campaign recommendations, and weekly growth plans.
- Operate voice, chatbot, WhatsApp, calendar scheduling, and email confirmation workflows.
- Communicate with users, respond to inquiries, provide support, and send administrative notices.
- Process payments, manage subscriptions, issue invoices, and prevent fraud.
- Monitor security, debug issues, prevent misuse, and enforce our Terms.
- Develop new features, improve product performance, and analyze aggregate usage trends.
- Comply with legal obligations and protect the rights, safety, and property of Nexcom AI, our users, and others.
3. Customer Data and Controller Responsibilities
Our customers may upload or submit lead, prospect, and customer data into the Services. As between Nexcom AI and the customer, the customer is responsible for determining whether it has the right to collect, upload, contact, process, and use that data. Customers are responsible for their own compliance with applicable privacy, marketing, telemarketing, email, WhatsApp, and consent laws.
Nexcom AI processes customer-provided data to provide the Services. We do not sell customer lead lists or customer databases. We may process customer data through trusted vendors as described below.
4. AI Processing
The Services may use artificial intelligence providers to generate drafts, recommendations, summaries, classifications, and other outputs. AI-generated outputs may be inaccurate, incomplete, or unsuitable for a specific use. Customers are responsible for reviewing and approving outputs before using them in business decisions or customer communications.
Do not submit sensitive personal information unless it is necessary for the Services and you have the right to do so. The Services are not designed to process protected health information, financial account numbers, government identification numbers, children's data, or other highly sensitive data.
5. How We Share Information
We may share information with:
- Service providers: hosting, database, authentication, AI infrastructure, email, analytics, support, payment processing, communications, and security vendors.
- Customer-authorized integrations: calendar, email, WhatsApp, CRM, payment, or other tools connected by a customer or administrator.
- Professional advisors: attorneys, accountants, insurers, auditors, and consultants.
- Legal and safety recipients: law enforcement, regulators, courts, or other parties when required by law or necessary to protect rights, safety, security, or prevent fraud.
- Business transfers: parties involved in a merger, acquisition, financing, reorganization, sale of assets, or similar transaction.
We do not sell personal information in the ordinary meaning of selling customer lists for money.
6. Communications, Email, WhatsApp, and Scheduling
Lead Concierge AI may help customers communicate with their prospects or customers through voice, website chat, WhatsApp, email confirmations, and calendar scheduling. Customers are responsible for ensuring they have appropriate consent or another lawful basis to contact individuals through these channels. Customers must honor unsubscribe, opt-out, do-not-contact, and messaging platform requirements.
7. Cookies and Analytics
We may use cookies, local storage, pixels, analytics tools, and similar technologies to operate the website, remember preferences, understand usage, improve performance, and protect the Services. Browser settings may allow you to limit or block some technologies, but certain features may not work properly without them.
8. Data Security
We use reasonable administrative, technical, and organizational safeguards designed to protect information. However, no system, network, or transmission is completely secure. Customers are responsible for maintaining secure passwords, limiting user access, and ensuring their own systems and connected accounts are protected.
9. Data Retention
We retain information for as long as needed to provide the Services, maintain business records, comply with legal obligations, resolve disputes, enforce agreements, and protect against fraud or misuse. Customers may request deletion of certain account or customer data, subject to legal, security, backup, and legitimate business retention needs.
10. Your Choices and Rights
Depending on your location, you may have rights to access, correct, delete, restrict, object to, or receive a copy of certain personal information. You may contact us at hello@nexcomai.ai. We may need to verify your request.
If your information was submitted by one of our customers, we may direct you to that customer because they control the data and the purpose of processing.
11. Children
The Services are intended for businesses and are not directed to children under 13. We do not knowingly collect personal information from children under 13.
12. International Users
Nexcom AI LLC is based in the United States. If you access the Services from outside the United States, your information may be processed in the United States or other locations where our service providers operate.
